I have developed a specialized (epilepsy) medicolegal and expert witness practice since 2002, instructed by both claimants and respondents, defendants and prosecutors, and as a court appointed single joint expert, including instructions now from several large firms and organizations. A medicolegal expert report requires detailed information about the individuals background, medical history and current situation. Data is typically obtained from medical records, other reports and statements provided by the instructing solicitors, and directly form patients and/or those caring for them. Consent to hold personal data from patients I am assessing in this context is confirmed at first assessment, and considered continuing unless otherwise advised.
Paper files are stored securely, accessible only to me, and shredded on completion of proceedings. Draft and final reports will be shared by me only with my medicolegal PA (also GDPR compliant), and instructing solicitors, unless explicit (usually written) consent to do otherwise has been agreed and documented. Electronic notes copies of my final reports are stored on Regularly updated Microsoft Office 365 for business systems, and with bitlocker encryption on hardware devices. Such files are retained for up to 7 years in case of matters arising, and for tax purposes as evidence of work undertaken. Any material retained beyond that for professional development purposes have personal identifiable details redacted.
Further information and requests for data removal should be directed to me (contact page), and will be acted on as promptly as possible, and confirmed with you. However, if consent is withheld or withdrawn, it will usually not be possible to proceed with the report and may delay court proceedings.
